���The EPA decision relied on data methodologies that are a
departure from and not a logical outgrowth of the proposal, and is
otherwise arbitrary,��� says the NASF���s Jeff Hannapel.
Law360, a website that covers the legal industry, rated Martell
as one of the top 10 environmental attorneys in the U.S. When
Martella was appointed EPA General Counsel by President George
W. Bush, he admitted in his Senate confirmation hearing that he
was pro-business and hoped to bring sensibility to the EPA legal
department.
���Environmental decisions should not be made without regard to
their economic and social consequences, and should be crafted to
preserve our nation���s economic competitiveness while protecting
our environment,��� Martella said in 2006.
In addition to NASF, Earthjustice also filed a legal challenge on
behalf of the Sierra Club, claiming that the final EPA rule was not
stringent enough.
���These actions put NASF in the position of trying to persuade
EPA to revise the final rule to more reasonable levels based on
scientific data, while at the same time trying to prevent EPA from
making the rule even more stringent pursuant to the claims of the
Sierra Club,��� Hannapel says.
Anticipating the EPA move, the NASF started a legal defense
fund several years ago to help fight the agency. Richter said the
industry���s Government Advisory Committee is working with its
peers in the surface finishing industry to promote efforts to stop the
EPA from making unwarranted regulatory decisions based on faulty
science.
