W ho did the National Association for Surface Finishing (NASF) hire to go after the U.S. EPA in its legal fight over the agency���s final chromium electroplating rules? The EPA���s former top lawyer, that���s who. The organization brought in attorney Roger Martella to battle the National Emission Standards for Hazardous Air Pollutants (NESHAP), filing a legal challenge in late November with a petition for judicial review of the ruling in the D.C. Circuit Court of Appeals and a request for reconsideration of the rule. Martella is with the Sidley Austin law firm in Washington, D.C., and one of the biggest hitters when it comes to environmental law. He served as the General Counsel to the EPA until 2008, concluding a 10-year career of litigating and handling complex environmental and natural resource matters at the U.S. Department of Justice and the EPA. As the agency���s General Counsel, Martella supervised 350 attorneys and staff in Washington and 10 regional offices. Now, he���s taking the EPA to court on behalf of the plating industry. ���This is an extremely important case, not only for platers but for the entire surface coating industry,��� says NASF Executive Vice President Christian Richter, who has known Martella for several years and enlisted him to speak at the NASF���s Washington Forum conference in 2012. ���This particular case happens to be a chromium rule, but it has implications for the broader finishing community.
